In an official statement today, Samsung has announced that the Korean tech giant has filed a motion against Cupertino based Apple Inc. over the newly launched iPhone 5.
Samsung has accused Apple’s iPhone 5 to be infringing on some of the patents held by the company.
The company has officially said,
We have always preferred to compete in the marketplace with our innovative products, rather than in courtrooms. However, Apple continues to take aggressive legal measures that will limit market competition. Under these circumstances, we have little choice but to take the steps necessary to protect our innovations and intellectual property rights.
We had heard about Samsung planning to sue Apple over iPhone 5 a few days back and now it is confirmed. But it’ll be interesting to see as to which patents Samsung will include in the motion against Apple’s latest iPhone.
Also in a separate decision earlier today, a US court has lifted a temporary sales ban that it had imposed on June 26th on Samsung’s Galaxy Note 10.1 after it found that the jury found earlier that Samsung did not breach the D’889 design patent held by Apple.
Now Samsung will be able to sell its Galaxy Note 10.1 in the US again and might be looking forward to the holiday season.
Samsung has in an official statement said,
We are pleased with the court’s action today, which vindicates our position that there was no infringement of Apple’s design patent and that an injunction was not called for.
